TERMS AND CONDITIONS

General - The following are the rules or "Terms" that govern use of the ACheapSeat.com Web site ("Site"). By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site. ACheapSeat.com reserves the right to change these Terms at any time, effective immediately upon posting on the Site. If you violate these Terms of Use, ACheapSeat.com may terminate your use of the Site, bar you from future use of the Site, cancel your ticket order, and/or take appropriate legal action against you.

Ticket Prices - Tickets sold on our website are often obtained through the secondary market and are being resold, in many cases, above the price or "face value" printed on the ticket. All ticket prices include additional convenience charges and shipping fees as defined on each order. The convenience charge helps us recover some of the costs associated with processing payments, securing, as well as guaranteeing that every ticket on the site is authentic. We are NOT directly affiliated with any performer, sports team, or venue; and we do not act as a primary sale box office, . By agreeing to our terms, the user agrees that the purchase price for tickets on their order does NOT reflect the original purchase price of the ticket and may be either higher or lower than the original purchase price.

Orders - All sales are FINAL. Since tickets are a one-of-a-kind item and NOT replaceable, there are NO refunds, exchanges or cancellations. This policy is in place because when you purchase your tickets, we secure and acquire those tickets for you and are not able to recover our costs. If an event is postponed, there are NO refunds. Your tickets will be honored for the rescheduled date. New tickets will not need to be issued. ACheapSeat.com is NOT responsible for notifying customer of rescheduled date. Refunds on canceled shows will be honored if requested in writing within 10 days of the date of the cancellation but any shipping and convenience charges are NOT refundable. ACheapSeat.com will not issue exchanges or refunds after a purchase has been made or for lost, stolen, damaged or destroyed tickets. When you receive your tickets, please keep them in a safe place. Please note that direct sunlight or heat can sometimes damage tickets.

Ticket Availability - Seats in all listed ticket groups are side by side unless otherwise noted. Much of the inventory listed on our site is real time but occasionally, the tickets you order may no longer be available at the time your order is received. We reserve the right to upgrade your order at no extra cost if your seats are no longer available (upgrade is a section with the same vantage point or a mirror image of that vantage point. It also may be a section closer to the stage or closer to the center of the event). If no alternates are available, the User's credit card will not be charged at all.

Shipping – Most orders are processed the same business day in which they are received. Orders placed after hours will be processed on the next business day. For certain events, tickets may not be available for immediate shipment. In this case, a ACheapSeat.com representative will contact you with notification of approximately when your tickets will be shipped. ACheapSeat.com will NOT be responsible for delay in delivery due to weather conditions, or act of god. If you (the customer) have a release signature on file with Fedex, ACheapSeat.com will NOT be held responsible for any lost or stolen packages.
 
ACheapSeat.com. uses FedEx to ship all packages. When selecting FedEx as your delivery method, you agree to accept all of the Terms and Conditions FedEx applies to their service. If you feel that your enviroment is not secure for a Fedex delivery please call us immediately about an alternative delivery method. FedEx will leave a package without a signature if feels the environment it is leaving the package in is secure. By ordering tickets on ACheapSeat.com you agree that once FedEx acknowledges that the package has been delivered to the address given that ACheapSeat.com has done its job and has satisfactorily delivered the package.  You agree that if FedEx leaves a door tag slip or any other communication that your package has arrived that ACheapSeat.com has done its job and has delivered the package successfully.   Refusing delivery or refusing to sign for the ticket package does not release you from your agreement with our company and that you the customer are aware that you are responsible for any return shipping costs. ACheapSeat.com does reserve the right, at its discretion, to require a signature upon delivery.

Limitations Of Liability - Due to the fact that our inventory is posted from various outside suppliers we cannot be held responsible for any typographical errors or incorrect ticket listing. ACheapSeat.com cannot be held responsible for replacement tickets. If the error is found prior to confirmation you will be notified by a ACheapSeat.com representative and your order will be canceled with no charge to your credit card. If the error is found after your order is confirmed your order will be canceled and refunded; if the tickets have shipped we will only refund you once the tickets are returned to our office, which must be within 10 business days in order to receive the full refund. In the event that you miss your event or are delayed to the event due to an act of ACheapSeat.com, a partial or full price of the ticket order will be reimbursed, however we are not responsible for any other travel related expenses in such situations. Occasionally weather conditions may affect travel to your event and in this case, ACheapSeat.com is not responsible for the missing or delay of an event.

Governing Law And Jurisdiction - This Agreement, and ACheapSeat.com and your obligations under this Agreement, will be governed by the laws of the State of Illinois without regard to its conflict of law provisions. By using the Web site or ACheapSeat.com services, you agree that all legal proceedings with respect to this Agreement, this Web site and ACheapSeat.com services must be brought in State or Federal court located in the County of Cook, State of Illinois, and you consent to the personal jurisdiction of and laying of venue in such courts. Nevertheless, we may seek to enforce any award in such proceedings against you in any other jurisdiction where you are located or have assets.

Permitted Use - You agree that you are only authorized to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase tickets or merchandise for your personal use, unless otherwise specifically authorized by ACheapSeat.com to do so. The content and software on this Site is the property of ACheapSeat.com and/or its suppliers and is protected by U.S. and international copyright laws.

Links - ACheapSeat.com may terminate your access to the Site, cancel your ticket order or exercise any other remedy available and remove any unauthorized User Content, if ACheapSeat.com believes that the User Content you provided has violated or is inconsistent with these Terms of Use violated the rights of ACheapSeat.com, another User or the law. You agree that monetary damages may not provide a sufficient remedy to ACheapSeat.com for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations. ACheapSeat.com may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. ACheapSeat.com is not required to provide any refund to you if you are terminated as a User because you have violated these Terms of Use.

Disclaimers- ACheapSeat.com does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from use of the Site or any Content, search or link on it. The Site and its Content are delivered on an "as-is" and "as-available" basis. ACheapSeat.com disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. ACheapSeat.com will not be liable for any damages of any kind arising from the use of this Site, including without limitation, direct, indirect, incidental, punitive and consequential damages.

ACheapSeat.com makes no guarantee of any specific result from use of this Site or use of the ACheapSeat.com service.
